Dear colleague,
You are receiving this message either because you have expressed an interest
in participating in the IEEE-SA Standard Board's Patent Committee
(PatCom) email discussion group or because you have a position of leadership
in the IEEE-SA that indicates that you should be given the opportunity to
participate.
A little background:
Two stimuli have prompted PatCom to step back and undertake a complete
review of the IEEE Patent Policy (see Clause 6 of the IEEE-SA Standards
Board Bylaws) as it relates to standards.  [IEEE-SA patent material at

   1. First, recent court cases have led IEEE-SA's legal counsel to
      strongly recommend that all standards-related IEEE patent policies,
      procedures, and practices be consistent at all echelons from the
      Bylaws to each WG's practices.  A person who participates in only a
      single IEEE Standards Working Group must have the same view of the
      policy and procedures as the members of the Standards Board.
   2. Second, ANSI (the American National Standards Institute) is expanding
      its Patent Policy into an Intellectual Property Rights Policy, which
      would address copyrights and trademarks as well as patents.  They are
      also considering several changes to the existing patent policy, how
      it is implemented, and how compliance with it would impact a
      standards organization's accreditation.
The bottom line is that this is a good time to exchange ideas among those of
us who are most interested and affected by the IEEE policy.  Our objective
should be to reach agreement in principle on what the provisions of the
policy should be and then to draft new text for the policy, if needed, and
for a single set of implementing procedures to be used at all echelons.

Using the web forum technology will allow more of us to be active
participants and will give us more time for discussion than we would have at
a face-to-face meeting.
I have identified a few topics we should discuss to get us started.
   1. Early Disclosure:  The Patent Policy does not mention early
      disclosure even though it is an integral part of the ANSI patent
      guidelines.  Should we add it to the IEEE policy?
   2. Reciprocity:  The Patent Policy does not mention reciprocity but it
      is a key consideration in the new ANSI policy.  Should we add it to
      the IEEE policy?
   3. Copyright:  The current draft of the new ANSI policy includes
      copyright rights.  Should we add them to the IEEE policy?
   4. Terms and Conditions:  The last PatCom meeting heard a proposal to
      allow discussion of licensing terms and conditions in Working Group
      meetings.  Should we make such a recommendation?
